Q:

Isn't a semi tractor-trailer accident pretty much the same as any other motor vehicle accident?

A:

Some aspects are the same but there are also many significant differences, mostly relating to the federal laws governing commercial trucks.  Since these trucks and trucking companies are subject to the Federal Motor Carrier Safety Regulation Act, violations of this Act often are at the heart of establishing liability on the part of the truck driver or his employer after a serious accident.  Among other things: 

  • Large commercial trucks are required to carry far more liability insurance than passenger cars. This makes potential claims against insurers much larger and they are defended very rigorously
  • Truck drivers are subject to limits on the number of hours that they can drive on a single day and during 7 and 8 day periods, and they must meet higher licensing and safety standards than the drivers of other types of vehicles.
  • Trucking companies bear a responsibility to perform thorough background checks, proper training, and periodic evaluations of the drivers they hire.
  • Drivers of semi-trucks are subject to random drug testing.
